| I am letting an unfurnished property so why do I need an Inventory and schedule of condition? |

The requirements of the Housing Act 2004 relating to tenants' deposits has changed the law to give tenants greater protection from unscrupulous landlords who abused the old rules. A side effect of this is that innocent landlords acting in good faith are often falling foul of the onerous conditions that put the burden of proof on the landlord.
Even unfurnished properties can be damaged, e.g. kitchen units can go missing, bedrooms can be redecorated with black paint and bathroom porcelain can be chipped and broken. If you do not have a inventory and schedule of condition you will have no proof that the conditions have changed and recent judgements suggest you would not be able to make any claim against the tenant whatsoever. With a schedule of condition professionally written you will be able to retain a part or all of the deposit and also be able to claim for damages against the tenant in the small claims court if the damage exceeds the deposit. |
